1. Who we are
dearyou (“we”, “us”) is run by Karan Dugar, a sole proprietor trading as dearyou, in India. Address: Phoolbagan, Kolkata 700085 (full address for legal notices on request: grievance@dearyou.page). The proprietor is also our Grievance Officer (see section 10). These Terms are an agreement between you and us. By creating an account or buying a gift page, you agree to them, to our Acceptable Use Policy, our Privacy Policy and our Refund & Cancellation Policy.
2. Who can use dearyou
- You must be 18 or older to create an account or buy a gift page.
- You sign in with a Google account. Keep it secure; you're responsible for what happens under your account.
- People who receive a gift page don't need an account and don't have to accept these Terms to view it.
3. What you get
dearyou lets you build a personal gift page from one of our templates and share it at a link of your choice on dearyou.page. You can build and preview for free. You pay once per published gift page, at the price shown for its template before you pay. Every paid page includes:
- unlimited edits after publishing,
- an optional password lock,
- a QR code for the link,
- a Manage page to edit, lock, take offline or bring back the page, and
- hosting for as long as dearyou operates (see section 8).
There are no subscriptions. Two pages are two purchases, even on the same template.
4. Page names
- Page names are first come, first served, and are held for 30 minutes while you pay.
- Once a page is published, its name can't be changed. Everything else on the page can.
- Some names are reserved. We may take back a name that impersonates a person, brand or organisation, infringes a trademark, or is used to mislead, and we'll tell you if we do.
5. Your content
- You keep ownership of everything you add: your words, photos and any song or voice note. You give us a non-exclusive, royalty-free licence to store, process, display and share it, only as needed to run dearyou and show your page to the people you share it with. This licence ends when your content is deleted, except for copies we must keep by law (see our Privacy Policy).
- Before you upload photos, you confirm that you have the right to use them and the consent of everyone shown in them. Before you upload a song or voice note, you confirm that you have the right to share it. You are responsible for what you upload and share.
- Your content must follow our Acceptable Use Policy.
6. Our content
Templates, designs, illustrations, music, code and the dearyou name and logo belong to us or our licensors. You may use them only as part of your gift pages on dearyou.
7. Payments
Prices are in Indian rupees and are shown before you pay. Payments are processed by Razorpay; we never see or store your card or bank details. A page is published only once we've confirmed your payment. Promo codes apply to the template price, have their own limits and expiry dates, and can't be exchanged for cash. Refunds are covered by our Refund & Cancellation Policy.
8. How long pages stay up
Published pages are hosted for as long as dearyou operates. We don't promise “forever”. If we ever decide to shut dearyou down, we'll give at least 60 days' notice by email to account holders before any page goes offline. We aim to keep pages available at all times but can't guarantee uninterrupted service.
9. Taking pages down and suspending accounts
We may take down a page, or suspend or close an account, if it breaks these Terms or our Acceptable Use Policy, if we receive a valid complaint or legal order, or if we need to protect people or the service. Where the law allows, we'll tell you why. Pages taken down for breaking our rules are not refunded. We keep records of removed content as the law requires.
10. Complaints and our Grievance Officer
Anyone can report a page through Report a page or by writing to our Grievance Officer (named in section 1) at grievance@dearyou.page. We acknowledge complaints within 24 hours and resolve them within 15 days, as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
11. Liability
dearyou is provided “as is”. To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you for any claim is limited to the amount you paid us for the gift page concerned. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019, or any liability that can't be limited by law.
You agree to compensate us for losses caused by content you upload or by your breach of these Terms, including claims by people shown in your photos and by the owners of any music you upload.
12. Changes
We may update these Terms. We'll post the new version here with its effective date and, for significant changes, email account holders beforehand. Continuing to use dearyou after that date means you accept the new Terms.
13. Law and disputes
These Terms are governed by the laws of India. The courts at Kolkata have jurisdiction, subject to your rights as a consumer to bring a complaint where the law allows.
