1. The agreement
These terms are between you and Karan Dugar, a sole proprietor trading as dearyou (“dearyou”, “we”). You accept them when you tell us you're joining, or when you first use a code or link we gave you. Our Terms of Service and Acceptable Use Policy also apply, including to the gifts you make. If anything here conflicts with a written deal we've signed with you, the written deal wins.
2. Who can join
- You must be 18 or older and able to receive payments by UPI in your own name.
- We choose who joins, and may say no without giving a reason.
- Your Instagram (or other) account must be yours, and its followers real.
3. What you get
- Free gifts: a code for 3 free gifts, for your own use. It can't be sold, shared or swapped for money, and free gifts don't earn commission.
- Your follower code: a code that takes 20% off for your audience. We set its discount and may end it with notice.
- Your link: a link that looks like
dearyou.page/?ref=yourhandle. - Commission: 25% of what the buyer actually pays for each sale credited to you, after any discount. Your rate is fixed on each order when it's placed, so a later change never affects what you've already earned.
- Your stats page: a private link showing your sales, earnings and payouts. It shows only your numbers, never who bought or what they made. Keep the link to yourself; we can replace it if it leaks.
If we agreed a different rate, a fee or extra gifts with you in writing, that applies to you instead of the standard offer on dearyou.page/creators.
4. How a sale is credited to you
Each paid order is credited to at most one creator, checked in this order:
- The creator whose code the buyer used at checkout (a code link remembers the code for 30 days).
- Otherwise, the creator whose link the buyer last came through, within 30 days.
- Otherwise, the creator whose link first brought the buyer to dearyou, within 90 days.
We work this out automatically when the order is placed. We can't credit a sale after the fact if the buyer didn't use your code or link, and we don't move a sale from one creator to another on request. Buyers can clear cookies or switch devices, so your code is the most reliable way to be credited.
5. Payouts
- We pay what you earned in a month by the 10th of the next month, by UPI to the ID you gave us. If you're owed less than ₹100, it carries over to the next month.
- Only paid orders earn. If an order is refunded or charged back, its commission comes off your next payout.
- You're responsible for the tax on what you earn. If the law requires us to deduct tax (TDS) from a payout, we will, and we'll give you the certificate. We may ask for your PAN before paying.
- We may hold a payout while we look into something that seems to break these terms. If we do, we'll tell you why, and pay what was earned fairly once we're done.
6. Posting about dearyou
- Say it's a collab. Turn on Instagram's paid partnership label, or start the caption with #ad or #collab, as the ASCI influencer guidelines require. This applies even if you only got free gifts.
- Be accurate. Show the real price, and only describe what the templates really do. Don't promise refunds, delivery times, features or discounts we don't offer.
- Get consent. Only film or show people who've agreed, and don't show private details such as phone numbers or addresses.
- Be yourself, not us. Make it clear you're a creator talking about dearyou, not dearyou itself or our staff.
- You may use the dearyou name, screenshots and screen recordings of your own gifts to describe us. Don't change our logo or use it as your own.
- You keep creative control of your posts. We don't approve captions or edits.
7. What isn't allowed
Any of these can cost you the commission involved, and serious or repeated cases end your place in the programme:
- Earning on your own purchases, or on orders from your second accounts, or from friends set up just to earn commission.
- Selling or sharing your free-gift code, or charging someone to make a dearyou gift for them outside a normal purchase.
- Getting your link or code onto people who didn't choose it: hidden links, auto-redirects, browser extensions and the like.
- Posting your code on coupon sites, or sending spam or unsolicited bulk messages.
- Running paid ads on the word “dearyou”, or ads that look like they're from us.
- Handles, pages or domains that could be mistaken for ours.
- Fake reviews, fake urgency, or saying something about dearyou that isn't true.
- Promoting dearyou alongside content that is hateful, sexual, harassing or illegal.
- Buying gifts in order to have them refunded after commission is recorded.
8. Using your posts
You own what you post. For any post about dearyou you make while in the programme, you give us a free, non-exclusive, worldwide permission to:
- reshare or repost it on dearyou's own social accounts;
- show it, or a part of it such as a clip, a screenshot or a quote, as a testimonial on our website, in our emails and on our own social accounts;
- trim, crop, caption or subtitle it to fit, as long as we don't change what you said.
We'll credit you with your handle wherever we can. We won't use your content in paid ads without asking you first. This permission continues after you leave the programme, but if you ask us to stop using a post, we'll remove it from our website and stop using it anywhere new within 14 days.
9. Our relationship
You join as an independent creator. This isn't employment, a partnership or an agency, and it isn't exclusive: you can work with other brands, including other gift sites. You can't make promises or agreements on our behalf. Buyers' orders are with us, and we handle their support and refunds.
10. Changes and leaving
- We may change the standard offer or these terms. We'll update this page first, and a change applies only to orders placed after it.
- You can leave any time by telling us. Your codes and link then stop earning.
- We may end your place in the programme with notice, or straight away for a serious breach. Either way, commission you earned fairly before it ended is still paid.
11. Liability, law and contact
Commission and payouts are our whole obligation to you under these terms. They're governed by the laws of India, and the courts at Kolkata have jurisdiction. Questions about a sale, a payout or anything here: support@dearyou.page.
